Terms and Conditions
Intermediary Role:

Please note that Cosmos Yachting always acts as an agent for the charter company abroad. For our clients this means that your contract is always entered into directly with the company abroad and not with Cosmos Yachting. All charter companies represented by Cosmos Yachting have the official government authorization to charter yachts. We are entitled to issue charter contracts for all our principals and also to receive payments on their behalf.

Cosmos Yachting provides a highly responsible and professional service to both customers and partners. All bookings, confirmations, agreements, changes and cancellations must be made in writing.

Sailing License:

To be allowed use of a bareboat yacht, you will need a sailing certificate (RYA Day Skipper certificate) for most European destinations. In Greece, the co-skipper will also need a proof of competence - RYA Competent Crew.

The port authorities usually only require an official license. Cosmos Yachting requires additional proof of adequate sailing experience, such as information about the number of miles sailed or sailing school attended.

No certificate is required for flotillas. If you book a motor yacht in open waters, you must have a motor boat license.

No licenses are usually required overseas.

Charter Bookings:

Your yacht is considered booked if we receive a down payment at the time the contract is signed. The point at which the other balances are due depends on the third party and may vary. In Greece, it is mostly due upon embarkation; in other cruising areas, six weeks before the charter commences.

Verbal agreements only take effect after written confirmation by the charter company. Information is provided to the best of our knowledge and belief. Errors can, however, not be ruled out. Liability cannot be accepted in such cases.

The cancellation fee may vary, and the exact amount can be found on the charter contract.

For all charter contracts and other bookings, the full fee is payable on completion of booking, irrespective of whether you actually make use of the yacht, and other services. We therefore strongly recommend that you take out comprehensive travel insurance.
If you need to withdraw from the contract for unavoidable reasons, you may suggest a suitable replacement, who can take over the contract. If this is not possible, the charter company will try to charter the boat to someone else. Should this be successful, then you will be entitled to a repayment of 80% of the charter price. This repayment is calculated in proportion to the contract for which a replacement could be found.

Beyond this, you have no claim or redress, so it is recommended that clients take out comprehensive travel insurance. Such insurance can be obtained through us; however, in accordance with the general terms and conditions of the insurance company.

Insurance:

All yachts are covered by hull insurance, depending on the value of the yacht. Additionally, third party insurance is taken out for all yachts. Please note that dinghies, outboard motors, spinnakers and windsurfers are not covered by the insurance.

At the start of the charter, the client must pay a security deposit in cash, banker’s draft or by credit card, to the charter company. This deposit is used to pay for damage and losses not arising from normal wear and tear, and not covered by hull insurance. If the yacht is returned in the same condition, the deposit will be refunded.

Yachts are placed at your disposal by their owners for your sailing holiday. Responsibility for completing the trip is exclusively yours. During the preparation for your charter, you must take into consideration the weather conditions, as well as the experience of the crew.
Yacht hand-over: All our partners do their utmost to ensure that the yacht is handed over in a swift and timely manner. You should, however, take your time to familiarize yourself with the yacht, bearing in mind that damage may have been caused during your predecessor’s charter. Repairing such damage may require additional time and may, in the interest of your safety, delay the handover. The time taken to hand over and return the yacht falls within the duration of the charter, and does not extend it.

If the yacht is not available at the agreed handover time, the charter company is obliged to provide an equivalent yacht as a replacement within 48 hours. You then have the option of extending the charter contract by the duration of the delay (provided the owner agrees), or being reimbursed proportionally for the time lost. If it is not possible to provide a replacement yacht within 48 hours, you will be reimbursed in full, but without any claim to compensation.
All prices are usually inclusive of tax. Local taxes, harbor dues, airport taxes, security fees and charges for the transit log and the transfer are not included unless otherwise stated in the price lists. You are responsible for meeting local rules and other legal regulations, as well as observing passport, customs, and license restrictions.

Our domestic and international partners reserve the right to change, without declaration of reason and without notice, the prices quoted in the lists. Furthermore, those local taxes and fees included in the prices may vary due to fluctuation in exchange rates, resulting in price adjustments. Charter contracts already signed and completed are not affected.

All quotations of prices, technical references, and other information are provided to the best of our knowledge and belief. Errors and misprints cannot however be ruled out.

Mutual trust is the basis of yacht chartering. We and our partners trust you, by placing a yacht in your care whose value far exceeds the charter price.

In Greece, a compulsory standard charter contract is used, in accordance with government regulations. The charter contracts used by Cosmos Yachting conform with international practice, although the wording may vary. We will be happy to send you sample contracts.
Flight bookings: You can book suitable flight connections directly with any of our fully bonded associated flight companies, who can arrange all scheduled and charter flights.

Transfers:

If you wish, we can organise your transfers from the airport to the port of departure.

Provisioning:

In order to make life easy, we can supply all the food you need from quality local providers. To find out more, please request our provisioning lists.

Insurance:

Besides travel cancellation insurance we can offer you tailored insurance packages in partnership with Elvia.

Training:

In co-operation with some sailing schools, we can offer you training programs lasting a weekend or one week. At the end of the course, an exam is taken to obtain an RYA certificate.
